You will first meet with a criminal defense lawyer for an initial consultation. In some circumstances we are willing to meet with the client if he or she incarcerated. When it is possible, we prefer to get involved in a criminal case as early as possible. Doing so (either with our firm or another) is one of the best ways to put the case on the right track for a good result. For example, this is particularly important with DUI/DWAI cases for the reason that individuals charged with those offenses must act very quickly (typically within a week of receiving a summons for DUI/DWAI) or they may lose their chance to request a DMV hearing to determine whether they have a right to keep their driver's license. In all other criminal defense cases it is just as important that a client be represented by an attorney as early as possible to ensure that no critical deadlines are missed. Upon entering our appearance in our client's case, we immediately begin working by first reviewing all case evidence to assess the strengths and weaknesses of the prosecution's case. During assessment of the evidence, our Colorado criminal defense lawyers also determine whether any evidence obtained was done so in violation of the law and our client's rights. If so, we will draft, file and argue legal motions to ensure that the client's rights are being protected to the utmost extent under the law. At each step of the process your criminal defense attorney will discuss the case with the client to develop and maintain an ongoing strategy in line with the client's goals. We then work with the prosecuting attorney to advocate for a result that is in line with our client's goals. If our client's goals cannot be met by negotiation with the prosecuting attorney, we explore all other options, including defending our client at trial. We will never force a client to accept a plea offer unless the client is satisfied with the offer. Moreover our Colorado criminal defense attorneys offer a benchmark based fee structure which allows the client to have representation even if the client knows he could never afford trial (unlike some attorneys who will charge a flat rate no matter what the outcome is, which in our opinion, severely incentivizes the attorney to settle early).
